COMMISSION TERMS OF SERVICE

Henceforth, Luna (@keldopluna, @qtpals, @keldop) will be referred to as "The Artist", and the commissioner will be referred to as "The Client."Please read the terms before placing your order. If anything is unclear, the Client is encouraged to clarify with the Artist beforehand. The Artist will not be held liable for any additional costs incurred due to the Client not reading or understanding the Terms of Service (TOS).The artist draws:
- Chibi
- Original Characters (OC) / FanartThe Artist will not draw:
- M18 / NSFW content
- Design based only on written descriptions (no visual references)The Artist reserves the right to stream the commission process unless explicitly requested not to by The Client.Commission files will be retained by The Artist for a maximum of 6 months. After delivery, it is The Client’s responsibility to download and store their commissioned files.The Artist's work must not be used for NFTs or AI training purposes.

PRIVACY POLICY

Both the Client and the Artist agree to maintain the confidentiality of all personal or business information related to all involved parties.The Artist will comply with the Personal Data Protection Act (PDPA).Personal data such as names, contact information, and payment details will be collected solely for the purpose of fulfilling commission requests and communicating with the Client.By commissioning the Artist, the Client consents to the collection, use, and disclosure of their personal data as outlined in this policy.All personal data collected will be used exclusively for managing and delivering commissioned artworks. The Artist will not use the Client's data for any other purpose without explicit consent.The Client’s personal data may be disclosed to third parties (e.g., payment processors or delivery services) only when necessary to complete the commission. The Artist will not share the Client’s data with third parties for marketing or promotional purposes.The Client may withdraw their consent to the use or disclosure of their personal data at any time by contacting the Artist. However, doing so may affect the Artist’s ability to fulfill the commission.

PAYMENT POLICY

Full payment is required from the Client upfront before the Artist begins any work.

REVISION POLICY

The Artist allows a maximum of one (1) complimentary revision. Any additional revisions may incur extra charges. Please note that refunds will not be provided.

DEADLINES AND DELIVERY

The Client is required to inform the Artist about the deadline upfront.Expected Wait: Typically 1 week to 3 months, depending on commission type and complexity.
Please note that the 3-month timeframe accounts for the Artist’s full-time job — thank you for your understanding and patience!

usage

All commissions are for personal use only.For commercial use, the Client must inform the Artist in advance.Additional fees will apply unless explicitly stated otherwise.

INTELLECTUAL PROPERTY RIGHTS

Any use of the commissioned artwork for NFTs or Artificial Intelligence (AI) training is strictly prohibited.The Client has the right to publish or upload the commissioned artwork to any website or platform.
Credit is not required, but it is always appreciated.The Artist reserves the right to showcase the commissioned artwork in their portfolio and on their social media platforms.

REFUND POLICY

1. Partial Refunds
If a client cancels the commission after work has begun, a partial refund may be issued based on the amount of work completed.
Sketch Phase: 50% refund
Line Art/Initial Design Phase: 30% refund
Final Stages (Coloring, Detailing): No refund2 Full Refund Before work begins
A full refund is available if the client cancels before any work has started.3. Refunds in Case of Inability to Complete
If the artist is unable to complete the commission due to unforeseen circumstances (e.g., health issues), a full or partial refund will be issued based on the situation.4. Refunds for Missed Deadlines
If the artist fails to deliver the final product within 2 weeks after the given deadline without prior notice or a reasonable excuse, a partial refund on the final price may be offered.
For example, the deadline given by the Client is 1 Jan. If the artist doesn't deliver by 15 Jan, a partial refund is granted with reference to point 2(Partial Refunds) under Refunds Policy.
If the Client gives an extension of the deadline, this policy applies to the new dateline.5. Digital Goods Policy
For digital art, refunds may not be available once the final product is delivered, as digital files can’t be “returned.”

COMMUNICATION

Commission-related communication will take place on the platform where the commission was made (e.g., VGen DM, Discord, Instagram DM, Twitter DM, or Email).The Artist will maintain communication with the Client throughout the process until the commission is completed.
